1. Acceptance of Terms

By accessing or using TravelFun.ai (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

TravelFun.ai is an AI-powered assistant platform designed for travel agents. The Service provides access to AI chatbots, pre-built prompt templates, mini-applications, image generation tools, and other productivity features to help travel professionals generate leads, close deals, and streamline their workflows.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Maintain the security of your password and account.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized access or use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Generate, transmit, or store content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Use the Service to send spam, bulk unsolicited messages, or phishing communications.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated means to access the Service except through our provided APIs.

5. AI-Generated Content

The Service uses artificial intelligence to generate text, images, and other content. You acknowledge and agree that:

  • AI-generated content may not always be accurate, complete, or up-to-date.
  • You are responsible for reviewing and verifying all AI-generated content before use.
  • We do not guarantee the accuracy, reliability, or suitability of AI-generated content for any particular purpose.
  • AI-generated content should not be considered professional advice (legal, financial, medical, or otherwise).
  • You retain ownership of the prompts you submit, and you are granted a license to use the AI-generated output for your business purposes.

6. Credits, Subscriptions, Pricing, and Refunds

The Service operates on a credit-based system for AI-powered features. By using the Service, you acknowledge and agree to the following:

  • Credits have no monetary value. Credits are a virtual unit of measure for Service usage only and cannot be exchanged, transferred, sold, or redeemed for cash or any other form of payment.
  • No refunds for credits. All credit purchases and subscription fees are final and non-refundable. This includes unused credits, partially used credit allocations, and subscription fees for any billing period.
  • Credits carry over. Unused credits from your monthly subscription allocation do not expire and will carry over to subsequent months as long as your account remains active.
  • Credits are non-transferable. Credits cannot be transferred between accounts or users.
  • Subscription tiers. Different subscription tiers (Bronze, Silver, Gold) provide different monthly credit allocations and features. Upgrading or downgrading your subscription may affect your credit allocation.
  • Credit deductions. Credits are automatically deducted when you use AI-powered features. The credit cost varies by feature type (text generation, image generation, video generation, etc.) and the AI model used.
  • Account termination. If your account is terminated for any reason, all remaining credits are forfeited and cannot be refunded or recovered.
  • Pricing changes at sole discretion. We reserve the right to modify, at any time and at our sole discretion, without prior notice: (a) subscription prices and fees, (b) credit costs per generation or feature, (c) the credit-to-dollar conversion rate, (d) monthly credit allocations for subscription tiers, (e) the price of additional credit packages, and (f) any other pricing-related terms. Your continued use of the Service after any pricing change constitutes acceptance of the new pricing.
  • AI provider costs. Credit costs reflect underlying AI provider fees plus our operational costs and service margin. These costs may fluctuate based on third-party pricing changes, which may be passed on to users.
  • No price guarantees. Published prices, credit costs, and subscription rates are subject to change at any time. We do not guarantee any specific pricing for any period of time.

7. Third-Party API Keys

The Service allows you to provide your own API keys for third-party AI providers. By providing API keys, you acknowledge that:

  • You are responsible for any charges incurred through the use of your API keys.
  • Your use of third-party services is subject to their respective terms of service.
  • We are not liable for any actions taken by third-party providers.
  • We store your API keys securely but cannot guarantee absolute security.

8. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by TravelFun.ai and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our pre-built templates and mini-apps are proprietary and licensed for use within the Service only.

9. User Content

You retain ownership of any content you create, submit, or upload through the Service, including conversation history, custom prompts, and configurations. By using the Service, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the Service to you.

10. Service Availability

We strive to maintain high availability of the Service, but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TravelFun.ai and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of the Service.

In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or that the results obtained from using the Service will be accurate or reliable.

13. Indemnification

You agree to defend, indemnify, and hold harmless TravelFun.ai and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
